Laws That Pertain to Florida Gambling
Those who wish to research Florida gambling laws should pay special attention to the following parts of the Florida Constitution. Title XLVI focuses on criminal law, while Chapter 849 focuses on gaming laws and enforcement. We’ve included key excerpts of the law below.
Florida Casino Laws: 849.01 et seq; 550.001, et seq.

Florida bans most forms of casino gambling. Because of federal regulations passed by the 1988 Indian Gaming Regulatory Act, Native American tribes can host casino gambling on their sovereign reservations if they sign a gaming compact with the state. The Seminole Tribe of Indians holds a virtual monopoly over most forms of casino gambling in the state, though racinos exist.
Section 849.08
Whoever plays or engages in any game at cards, keno, roulette, faro, or other game of chance, at any place, by any device whatever, for money or other thing of value, shall be guilty of a misdemeanor of the second degree.
Florida bans wagering on unregulated games of skill. Jai-alai is an exception, but most games of skill remain banned under Florida laws.
Is Gambling Legal in the State of Florida?
Several types of gambling are legal in the state of Florida. Tribal gaming is the dominant form of gambling online in the state, generating billions of dollars. The Florida Lottery is a major source of revenue, while the multi-state lottery tickets are legal: Mega Millions (2009) and Powerball (2013). With the longest coastline in the United States and quick access to the Bahamas and the Caribbean nations, casino cruises are a huge attraction.
Thoroughbred racing and greyhound racing have been top attractions in the state, though dog racing soon will be a thing of the past. A new law in 2018 assures that no gaming expansion will happen without a statewide vote.

Is Online Poker Legal in Florida?
Florida residents can play online poker without fear of legal consequences. The state legislature has never discussed an online poker or online casino bill, but law enforcement and district attorneys do not fine or prosecute online poker players. Florida online casino gamblers sign up for offshore online and mobile casinos, poker sites, and sportsbooks. Those who register accounts should remember to do due diligence. Research an online gaming site’s licensing, software, and player reviews.
Is Sports Betting / Daily Fantasy Sports Legal in Florida?
Online sports betting takes place in offshore online sportsbooks. Individual players won’t be prosecuted for placing sports bets online or in a mobile casino, but read our reviews to see which are the safest sites with the best odds.
Sports betting is illegal in land-based casinos. In May 2018, the US Supreme Court repealed the PASPA federal ban on sports betting in 46 US states, including Florida. That means Florida has the right for the first time in 25 years to legalize bookmaker bets, if its leaders so wish.
What about Florida daily fantasy sports?
Daily fantasy sports are not regulated in the state of Florida. FanDuel and DraftKings operate in Florida, anyway. Some DFS sites do not. Before Yahoo! pulled the plug on Yahoo Fantasy Sports Daily, it did not accept Florida players.
Does Florida have land-based casinos?
Florida’s brick-and-mortar casinos are tribal. The Seminole Tribe of Indians owns all 7 land-based casinos in Florida. The Seminoles also own Hard Rock International, which owns casinos in other US states. The Seminoles have a monopoly on banked games and, in most places, on poker.
South Florida racetracks host poker games, but non-tribal poker is banned anywhere else in the state. The Seminoles agreed with departing Gov. Rick Scott’s administration to pay $3 billion in taxes over 7 years in a new gaming compact, but the state legislature blocked passage.

Amendment 3: Florida 2018 Elections
In the 2018 midterm elections, Floridians passed Amendment 3, which banned the expansion of gambling without a statewide vote. The Seminole Tribe and the Walt Disney Company paid a combined $10 million to back Amendment 3. Amendment 13 on 2018, which involved greyhound dog track racing, also involved gambling. Does Florida allow off-track betting?
No, Florida does not have off-track betting facilities the way Delaware or Arkansas does. Instead, you’ll find off-track betting at greyhound dog racing tracks and jai-alai frontons. Also, Amendment 13 allowed dog tracks to have simulcast racing and off-track betting. In South Florida, dog tracks will be able to host slot machines and poker clubs beyond the 2021 close date.
What about betting on Jai-alai?
South Florida has 5 Jai-alai frontons which allow betting. Because jai-alai is a sport and therefore a game of skill, it has special exemptions that otherwise would not exist. Jai-alai is a spor invented by the Basque people of Northern Spain. Jai-alai was popular in Cuba, so when many Cubans immigrated to South Florida in the wake of the Fidel Castro’s revolution in Cuba, the sport came with them.
Dubbed the fastest sport in the world by the Basque Government, these days jai-alai is a popular sport in the Miami area (and elsewhere in Florida). The frontons in the Miami area allow gambling. Bettors wager on tournaments, with bets to win, place, and show. Because of the way tournaments are structured (play until you lose), gambling on jai-alai can be profitable, according to Steven Skiena, a computer science professor at Stony Brook University in New York City.

Here’s a small sample of the bingo parlors in Florida.

- Is Social gaming allowed in Florida?
- Yes. The Seminole Tribe of Indians and Hard Rock International launched two social gaming sites in February 2018: www.hardrocksocialcasino.com and www.seminolesocialcasino.com. Both social games sites are powered by Greentube, a subsidiary of Austria’s Novomatic Group, mirror casinos games like electronic slots and table games, and have tournament play and high limit room options available.
- Because the Seminoles embrace social gaming, Florida is a safe haven for social gaming sites like Big Fish Games, Game Show Network (GSN) Games, and DoubleDown Casino (IGT). Social gaming is not considered a form of gambling by most states, including Florida.

- Is online gambling legal in Florida?
- Yes. Online gamblers are not prosecuted for playing at offshore online casinos. While online gambling isn’t regulated, FL law enforcement doesn’t fine or prosecute residents who play online.
- Are real money online casinos legal?
- Yes. The offshore online casinos which accept US players are beyond Florida’s jurisdiction. Individuals who play on those sites do not face legal consequences. The same goes for online sportsbooks and poker sites.
- Timeline of Florida Gambling Laws
- March 23, 2014 | Lt. Gov. Jennifer Carroll Resigns
- Florida newspapers reported that Allied Veterans of the World, a St. Augustine-based charity organization which generated revenues via Internet sweepstakes cafes, collected $300 million in winnings but only paid $6 million to charities. When it was learned that Lt. Gov. Jennifer Carroll was a paid consultant for Allied Veterans, she resigned from office.
- April 10, 2014 | Rick Scott Bans Internet Sweepstakes Cafes
- Florida Gov. Rick Scott signed HB 155, a bill which outlawed Internet sweepstakes cafes. HB 155 gained popularity in the wake of the Allied Veterans scandal. To this day, many anti-Internet cafe politicians in Florida continue to equate sweepstakes cafes with online gambling — a tenuous connection.
- April 3, 2014 | Rick Scott Opposes Online Gambling
- Gov. Rick Scott openly opposed Florida online gambling in public remarks on April 3, 2014. Scott said, “Although a national ban would be a better approach, I support a ban on internet gaming in Florida.”
- Opponents of online gambling like Rick Scott cite the Section 849.08 of the Florida Constitution Section. They specifically cite the term “by any device whatever” in the following comment: “Whoever plays or engages in any game at cards, keno, roulette, faro, or other game of chance, at any place, by any device whatever, for money or other thing of value, shall be guilty of a misdemeanor of the second degree.”
- September 27, 2018 | Ron DeSantis Opposes Online Gambling
- During the 2018 gubernatorial campaign, GOP candidate Ron DeSantis opposed gambling expansion, though he declined to say whether he opposed online gambling. Then-Rep. DeSantis said, “Florida must remain a family-friendly state, and I do not advocate for the expansion of gambling.”
- At the time, the storyline centered on Ron DeSantis’s opposition to Amendment 3. Florida newspapers reported he took money from opponents of Amendment 3, while he also worked as a paid consultant to Sheldon Adelson, the casino mogul who opposes online gambling through the Coalition to Stop Internet Gambling (CSIG). Thus, Gov. Ron DeSantis appears to be a devoted opponent of online gambling in Florida.
- February 15, 2019 | Online Sweepstakes Cafe Raids Continue
- Local law enforcement raided four sweepstakes cafes: Times Square Internet Sweepstakes Cafe, Lucky You 777, Cafe Gold Mine, and Dragon House. This followed similar raids in February 2018 and October 2018. Editorials in Florida newspapers called for officials to continue to raid Internet sweepstakes cafes and FL Attorney General Ashley Moody should prosecute the owners.

USA Online Casinos
Online Casino
Despite being the best place in the world to play at a land-based casino, the US has not quite emulated that success with respect to it's online casino offerings. Online casinos for USA casinos can be very good, but most of them are pretty average and there are also a number of very poor casinos, which do not treat players well.
So, you need to be careful when choosing a place to play.
When we started researching online casinos for USA players, we started with a list of over 300 venues. On the surface, nearly all 300 looked good - nice websites, good games and what looked to be very attractive bonus offers.
However, once we delved a little further into these casinos, into the terms and conditions, the trust, the way they treat players (slow cash-outs anyone?), the list got smaller and smaller.
Online Real Money Slots Florida State
By the time we finished, we were down to just 10 casinos that we could genuinely recommend to play if you want to gamble online if you live in the US.
Here, we have a list of the top 6 casinos for slots players that live in the US. All of these casinos have a wonderful reputation for trust and security and will allow you to cash-out your winnings when you want. Also, they all offer good, fair bonus offers.
Top Online Slots Real Money
The games at these casinos, like all casinos for USA players, are restricted to just a few producers, which are RTG, Rival Gaming, Betsoft and WGS. Some of the casinos also offer exclusive games that they have produced (like Slots.LV Casino), so if you are looking for something new and different, it is always worth signing up to all of them and deciding for yourself which one you want to play real money slots at afterwards. You can play the games for free, whilst you decide.
Online Slot Games That Pay Real Money
We continure to assess and test more casinos for USA players, so hope to be able to bring you more in the future, with even more games to play.
